TERMS AND CONDITIONS OF SALE
The online store www.kullakuu.ee (hereinafter the online store) is owned by Kullakuu OÜ (registry code 14879438), address Pääsküla 10-1, Tallinn, 10917.
Validity of the sales contract, products and price information:
The terms and conditions of sale are applied upon purchase of goods and services from the online store. Prices for products sold in the online store are listed by the products. Delivery fee will not be added to the price. All prices for the products listed in the online store are in euros. Information about the product is presented in the online store directly next to the product.
Completing an order:
- To order goods, the desired products shall be added to the cart. The required data fields shall be filled in to complete an order and the suitable delivery method shall be selected. The total amount payable will then be displayed that can be paid via the following payment options:
- Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay
- Visa/Mastercard card payments
- Paypal
NB! Be sure to click ‘Back to merchant’ when paying via a bank link. The payments are handled by Maksekeskus AS / MakeCommerce. The payment is made in a safe environment outside the online store – when paying via a bank link, in the safe environment of the respective bank and when paying with a credit card, in the safe environment of Maksekeskus AS / MakeCommerce. The seller does not have access to the customer’s bank or credit card information. The contract enters into force when the amount payable has been credited to the online store’s bank account. The online store acts as the controller of personal data and transfers personal data required for making payments to the processor Maksekeskus AS / MakeCommerce. If the ordered goods cannot be delivered due to the expiration of the goods or for any other reason, the buyer will be informed as soon as possible and reimbursed without delay, but no later than within fourteen (14) days of sending the notice.
Delivery:
The goods are delivered to all European countries. The buyer can choose between the parcel terminals of Omniva, Smartpost and DPD. The buyer bears the delivery costs.
As most of the products are custom made, in general, deliveries within Estonia reach the destination chosen by the buyer within 2-21 calendar days as from the date of entry into force of the sales contract.. Goods are delivered within 3-21 calendar days outside Estonia. In exceptional cases, goods may be delivered within up to 45 calendar days.
Right of withdrawal:
The customer has the right to withdraw from a contract entered into in the online store within 14 days as from receiving the goods. The right of withdrawal shall not be applied if the customer is a legal person. In order to exercise the 14-day right of return, the ordered merchandise may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the merchandise as permitted for testing at the physical store. If the goods have been used for any purpose other than what is necessary to ensure the nature, characteristics and functioning of the goods, or if there are any signs of use or wear and tear, the online store has the right to refuse from refunding.
To return the goods, submit an request for withdrawal containing the following information:
- which purchase contract you are withdrawing from;
- address of the consumer;
- bank account number of the consumer;
- signature of the consumer;
- date.
The request shall be sent to hello@kullakuu.ee no later than 14 days as from the receipt of the goods. The buyer must return the products within 14 days following submission of the request, or submit a certificate proving that the buyer transferred the products within the abovementioned period to the logistics company. The online store shall return immediately, within 14 days from the withdrawal at the latest, all the funds received under the contract. The online store may refuse to make the refund until it has received the item that was the object of the contract or until the buyer presents evidence that he/she has sent the item back, whichever is the earliest. If the buyer has expressly opted for a delivery method other than the least expensive standard delivery method offered by the online store, the online store shall not be required to reimburse the buyer for the costs which exceed the costs relating to the standard delivery method.
The online store has the right to withdraw from the contract of sale and recover the goods from the buyer if the price of the goods in the online store has mistakenly been listed as significantly lower than the market price of the goods.
The right to submit a complaint:
The online store is responsible for lack of conformity or defects of the sold goods, which existed already at the time of delivery, and that occurs up to two years, starting from the delivery of the goods to the buyer. Within the first six months of delivery of the item to the buyer, it is assumed that the defect already existed at the time of delivery. Rebuttal of this assumption is the responsibility of the online store. The buyer has the right to contact the online store within two months at the latest, by sending an email to hello@kullakuu.ee or by calling: +372 5629 5133. The online store is not liable for defects that have occurred after the delivery of the goods to the buyer. If the goods purchased from the online store have any defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store returns all fees related to the sales contract to the buyer. The online store will respond to the consumer ́s complaint in written form or in a format which can be reproduced in writing within 15 days.
Direct marketing and processing of personal data:
The online store uses personal data entered by the buyer only for processing the order and delivering goods to the buyer.. The online store forwards personal data to the transport service provider to deliver the goods. The online store shall only send newsletters and offers to the buyer's email address if the buyer has expressed his/her consent by entering an email address on the website and indicating his/her wish to receive direct mail notifications.
The buyer can unsubscribe from the offers and newsletters sent to his/her email address at any time by informing us via email at hello@kullakuu.ee or by following instructions provided in the emails that contain offers. Resolution of disputes If the buyer has any complaints about the online store, he/she can send an email to hello@kullakuu.ee or call: +372 5629 5133. If the buyer and the online store fail to resolve the dispute by agreement, the buyer can contact the Consumer Dispute Committee. The procedural rules can be found and the application can be submitted siin. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a buyer and the online store. Buyer complaints are reviewed by the Committee free of charge. The buyer may also contact a European Union consumer dispute resolution platform.
